(1) Scope of application
1.1 These General Terms and Conditions of AIP-enjoy GmbH (hereinafter referred to as the "Seller") apply to all contracts concluded by a consumer (hereinafter referred to as the "Buyer") with the Seller with regard to the goods and/or services presented by the Seller on www.growroom21.com. The Seller shall not be liable for any damages arising from the use of these General Terms and Conditions.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1.3 You may only purchase from us if you are at least 18 years old.
1.4 With your purchase, you undertake not to misuse the goods purchased from us for criminal acts, please pay attention to the respective laws which apply in your country.
(2) Conclusion of contract
2.1 The conclusion of a contract at www.growroom21.com is governed by the Distance and Foreign Transactions Act (FAGG).
2.2 The presentation of the products in the online shop is not a binding offer.
2.3 By placing an order via the "Order" button, the buyer makes a binding offer.
(3) Right of withdrawal
3.1 The buyer is entitled to withdraw from the purchase within 14 days after receipt of the goods.
3.2 The shipping costs for returning the goods shall be borne by the buyer.
3.3 The right of withdrawal according to § 11 FAGG cannot be asserted for the following products: Hemp cuttings, hemp seedlings, seeds, used/damaged goods, living beneficial plants. As seeds are natural, plant-based products, we cannot guarantee germination.
3.4 The right of withdrawal does not apply to consumers who do not belong to a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.
(4) Prices and shipping costs
4.1 Our prices include the statutory VAT rates of 10%, 13% or 20% plus shipping costs.
4.2 Information on our shipping costs can be found in the shipping costs table.
4.3 Since we cannot influence shipping circumstances, the shipping of living products such as beneficial plants, hemp plants and seeds is carried out under exclusion of any warranty.
(5) Terms of delivery and payment
5.1 Unless expressly requested by the buyer, our goods are not shipped insured. Upon acceptance of the delivery, the buyer is obliged to inspect the goods and to immediately complain to the courier about any apparent damage or to refuse acceptance.
5.2 The goods will be shipped to the address provided by the buyer. We ship our goods via Hermes Paket Versand and therefore have no influence on delivery times.
5.3 For natural products, such as hemp plants, seedlings, etc., we reserve a processing time of 3 weeks from receipt of payment, which means we can guarantee the highest quality for every customer. However, in most cases shipping can be provided much quicker.
