General Terms and Conditions (GTC) of AIP-enjoy GmbH / GrowRoom21
1. Scope of Application
1.1 These General Terms and Conditions (GTC) of AIP-enjoy GmbH (“Seller”) apply to all contracts concluded between a consumer (“Buyer”) and the Seller via www.growroom21.com.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade or profession.
1.3 You must be at least 18 years old to shop with us.
1.4 By purchasing, you agree not to use our products for illegal purposes and to comply with the laws of your country.
2. Conclusion of Contract
2.1 The formation of a contract via www.growroom21.com is governed by the Austrian Distance and Off-Premises Transactions Act (FAGG).
2.2 Product presentations in the online shop do not constitute binding offers.
2.3 By clicking the “Order” button, the buyer submits a binding purchase offer.
3. Right of Withdrawal
3.1 The buyer may withdraw from the contract within 14 days after receiving the goods.
3.2 Return shipping costs are borne by the buyer.
3.3 The right of withdrawal under § 11 FAGG does not apply to hemp cuttings, seedlings, seeds, used/damaged goods, or live beneficial insects. No germination guarantee is given for seeds.
3.4 The right of withdrawal does not apply to customers residing outside the EU.
4. Prices and Shipping Costs
4.1 All prices include VAT plus shipping costs.
4.2 Shipping cost details can be found on our website.
4.3 Shipping of live products such as hemp plants or beneficial insects is at the buyer’s risk and excludes any warranty.
5. Delivery and Payment Conditions
5.1 Goods are shipped uninsured unless requested otherwise. The buyer must check for visible damages upon receipt and report them immediately.
5.2 Orders are shipped to the address provided by the buyer. We use Hermes, GLS, or postal services and cannot influence delivery times.
5.3 Compensation claims for delay, impossibility, or non-performance are excluded.
5.4 Payment is accepted via prepayment. Credit cards are not accepted due to high fees.
5.5 For natural products such as hemp plants, a processing time of up to 3 weeks after payment may apply.
6. Retention of Title
6.1 The goods remain the property of AIP-enjoy GmbH until full payment is received.
7. Applicable Law
7.1 Place of performance is AIP-enjoy GmbH, Jedleseer Straße 67, 1210 Vienna.
7.2 Jurisdiction is the Commercial Court of Vienna.
7.3 Invalid clauses shall not affect the validity of the remaining provisions.
8. Incorrect Address and Contact Information
8.1 AIP-enjoy GmbH is not responsible for delivery failures caused by incorrect or incomplete address or phone information.
8.2 The customer must provide accurate information. All costs caused by incorrect information are borne by the customer.
8.3 Return and reshipping costs are to be covered by the customer.
8.4 A valid email address is required for order processing.
